1. Agreement to Terms
By accessing or using the services provided by Crunch Geek Inc. ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our services.
2. Services
Crunch Geek Inc. provides managed hosting services for WordPress and Laravel applications, including but not limited to server provisioning, monitoring, backups, security updates, and technical support.
3. Account Registration
To use our services, you must create an account and provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You must be at least 18 years of age to create an account and use our services.
4. Acceptable Use
You agree not to use our services to:
- Host content that is illegal, harmful, or infringes on the rights of others
- Distribute malware, spam, or engage in phishing activities
- Attempt to gain unauthorized access to our systems or other users' accounts
- Use excessive server resources that negatively affect other customers
- Resell or redistribute our services without written authorization
We reserve the right to suspend or terminate accounts that violate these terms without prior notice.
5. Billing and Payment
Subscription fees are billed in advance on a monthly or annual basis depending on the plan you select. All payments are processed through our third-party payment processor, Stripe.
Prices are subject to change with 30 days' notice. You may cancel your subscription at any time, and your service will remain active until the end of the current billing period.
Refunds are handled on a case-by-case basis. We offer a 14-day money-back guarantee for new customers on their first subscription.
6. Uptime and Service Level
We strive to maintain 99.9% uptime for all hosted services. Scheduled maintenance windows will be communicated in advance. We are not liable for downtime caused by factors beyond our reasonable control, including but not limited to natural disasters, third-party service outages, or cyberattacks.
7. Data and Backups
We perform regular automated backups of your hosted content. However, you are ultimately responsible for maintaining your own backups. We are not liable for data loss resulting from account termination, hardware failure, or other unforeseen events.
8. Intellectual Property
You retain ownership of all content you host on our platform. By using our services, you grant us a limited license to store, transmit, and display your content solely for the purpose of providing the hosting service.
All Crunch Geek Inc. branding, software, and documentation are our intellectual property and may not be used without written permission.
9. Limitation of Liability
To the maximum extent permitted by law, Crunch Geek Inc. shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of our services. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Termination
Either party may terminate this agreement at any time. Upon termination, we will provide a reasonable period for you to retrieve your data before it is permanently deleted from our servers.
11. Changes to Terms
We may update these terms from time to time. Material changes will be communicated via email or through a notice on our website. Continued use of our services after changes take effect constitutes acceptance of the updated terms.
12. Governing Law
These terms are governed by and construed in accordance with the laws of the jurisdiction in which Crunch Geek Inc. is incorporated, without regard to conflict of law principles.
